Terms of Service

1. Agreement to Terms.

Welcome to StayNam. By accessing or using our website, mobile application, or services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you and StayNam ("Company," "we," "us," or "our"). Please read these Terms carefully before using our Platform. By creating an account, making a booking, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Definitions.

For the purposes of these Terms:

  • "Guest" means a user who books or intends to book accommodation through the Platform.
  • "Host" means a user who lists accommodation on the Platform for booking by Guests.
  • "User" means any person who accesses or uses the Platform, including both Guests and Hosts.
  • "Listing" means an accommodation, property, or service offered by a Host through the Platform.
  • "Booking" means a confirmed reservation of a Listing by a Guest through the Platform.

3. Eligibility and Account Registration.

3.1 Eligibility.

To use the Platform, you must be at least 18 years of age and have the legal capacity to enter into binding contracts. By using the Platform, you represent and warrant that you meet these eligibility requirements.

3.2 Account Registration.

To access certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

3.3 Account Verification.

We may require you to verify your identity, contact information, or payment information. You authorize us to make inquiries to validate your account information, including through third-party services.

4. Using the Platform.

4.1 License to Use.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for your personal, non-commercial use.

4.2 Prohibited Activities.

You agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Platform for any commercial purpose without our prior written consent
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the Platform or servers or networks connected to the Platform
  • Use any automated means to access the Platform, including bots, scrapers, or spiders
  • Attempt to gain unauthorized access to any portion of the Platform or any other systems or networks
  • Transmit any viruses, malware, or other harmful code
  • Harass, abuse, or harm another person or discriminate based on protected characteristics
  • Post or transmit any content that is unlawful, fraudulent, defamatory, or obscene

5. Bookings and Payments.

5.1 Booking Process.

When you make a Booking, you agree to pay all applicable charges, including the accommodation price, service fees, taxes, and any other fees disclosed at the time of booking. All payments are processed through our secure payment system.

5.2 Payment Authorization.

By providing payment information, you authorize us to charge the payment method for all amounts due. You represent and warrant that you have the legal right to use any payment method you provide.

5.3 Service Fees.

We charge service fees to both Guests and Hosts for the use of the Platform. These fees are clearly displayed before you confirm a Booking or accept a reservation. Service fees are non-refundable except as provided in our Refund Policy.

5.4 Currency and Taxes.

All prices are displayed in the currency selected by the Host or converted to your local currency. Guests are responsible for any foreign exchange or currency conversion fees charged by their financial institution. Applicable taxes will be calculated and added to the total price at checkout.

6. Guest Responsibilities.

As a Guest, you agree to:

  • Read and comply with all Listing descriptions, house rules, and Host requirements
  • Treat the accommodation and Host's property with respect
  • Leave the accommodation in the same condition as when you arrived
  • Pay for any damage you cause to the accommodation or Host's property
  • Provide accurate information about the number of guests and the purpose of your stay
  • Not exceed the maximum number of guests allowed in the Listing
  • Not use the accommodation for any illegal activities or unauthorized commercial purposes
  • Follow all applicable laws and regulations during your stay

7. Host Responsibilities.

As a Host, you agree to:

  • Provide accurate, complete, and up-to-date information in your Listings
  • Ensure your Listing complies with all applicable laws, regulations, and zoning restrictions
  • Maintain appropriate insurance coverage for your property
  • Provide a safe and clean accommodation that matches your Listing description
  • Honor confirmed Bookings and not cancel except in extenuating circumstances
  • Respond promptly to Guest inquiries and booking requests
  • Treat Guests with respect and not discriminate based on protected characteristics
  • Comply with all applicable tax obligations related to your Listing

8. Cancellations and Refunds.

Cancellation and refund policies are determined by each Host and will be clearly displayed on the Listing page and in your booking confirmation. Please review our separate Refund Policy for detailed information about cancellations, modifications, and refund eligibility.

We reserve the right to cancel any Booking and refund Guests if we believe the Booking poses a risk to safety, violates these Terms, or is fraudulent.

9. Reviews and Ratings.

Both Guests and Hosts may leave reviews and ratings after a completed Booking. You agree that:

  • Reviews must be accurate, truthful, and based on your actual experience
  • Reviews may not contain offensive, discriminatory, or defamatory content
  • Reviews may not violate any person's privacy or include personal contact information
  • You may not manipulate the rating system or leave reviews in exchange for compensation

We reserve the right to remove reviews that violate these Terms or our Content Policy. Reviews are the opinions of individual users and do not reflect the views of StayNam.

10. Intellectual Property.

The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by StayNam, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You retain ownership of any content you submit or upload to the Platform. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, display, and distribute your content in connection with the Platform.

11. Privacy and Data Protection.

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

We implement reasonable security measures to protect your information, but no method of transmission or storage is completely secure. You acknowledge that you provide your information at your own risk.

12. Disclaimers and Limitation of Liability.

12.1 Disclaimers.

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE PLATFORM'S CONTENT OR THE CONTENT OF ANY LISTINGS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not endorse or guarantee the quality, safety, or legality of any Listings or the truth or accuracy of Users' descriptions. We are not responsible for the conduct of any User or the condition of any accommodation.

12.2 Limitation of Liability.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAYNAM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE PLATFORM.

13. Indemnification.

You agree to defend, indemnify, and hold harmless StayNam, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another person or entity.

14. Dispute Resolution.

If a dispute arises between you and another User, you agree to first attempt to resolve the dispute directly with that User. If you are unable to resolve the dispute, you may contact our support team for assistance.

Any disputes between you and StayNam shall be governed by the laws of Namibia and shall be resolved through binding arbitration in accordance with the rules of the Arbitration Foundation of Namibia, or in the courts of Windhoek, Namibia.

15. Termination.

We may suspend or terminate your account or access to the Platform at any time, with or without cause or notice, including if we believe you have violated these Terms or engaged in conduct that we deem inappropriate.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform will immediately cease. Termination does not affect any obligations or liabilities that arose before termination.

16. Changes to Terms.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date below. Your continued use of the Platform after changes are posted constitutes your acceptance of the modified Terms.

17. General Provisions.

These Terms constitute the entire agreement between you and StayNam regarding the Platform and supersede all prior agreements. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. You may not assign or transfer these Terms without our prior written consent.
